About 10PM last night, I look in my rear view mirror and see F-350 coming. Fast. So, I speed up. He tries to pass me in a no-passing zone, and slams into the side of me.

He then runs. I catch up. I get his plate number, turn around, drop my friends off, and call the cops.

In the mean time, he turns around and goes straight for the cops. He tried to tell them I RAN after HE HIT ME, but I had witnesses that said otherwise.

It's already been totalled once, so I have an R-Title. I'm going to need a new door, rear quarter panel, and front fender on my driver's side.

(Note to mods: This is now public info, as this is a criminal investigation)

The driver's name was Roger Bachle, License Plate #YMV-8931, PA plate. So, if you run into this guy (Red F-250 with a cap), just let him know that he's a 57 year old prick that deserves a slow, painful death. My car is probably going to be totalled.

Anyone near PA that has a nice 94-95 V8, or a nice 94-95 5-speed SC sitting around, PM me, as I will probably be buying a new car at this guy's expense in the next few weeks.

soory to hear that. i would suggest if you look for the v8 get the 96 0r 97 unless you are dead set on the look for 94-95 front end.

Ouch man, that sucks. I hope the investigation goes in your favor. Hit and run is a felony, aka he'll be royally hosed when they find him at fault. Hope it works out for you, don't let yourself get cynical or jaded when he starts telling more BS stores (and I'm 99% sure he will)

Where's the lawyers at? lol

I can prove this guy was lying because of the way the hubcap was stuck in my car - It couldn';t have been stuck where it was and unravelled if I passed him.

Should I sue the crap outta this guy? His insurance company is probably going to try and give me a couple hundred for my car, and I want what it's worth to me. Probably a little more - I sure as hell don't run like a bat out of hell after hitting anyone. I think he should be taught a lesson - 57 years of age or not.

I lost my custom '86 Cougar back in 2000 because some idiot in a pick-up pulled out in front of me. I had to swerve (to avoid killing him) and nailed the guardrail.
He fled the scene and was never caught.
Just as a shameless plug, here's what it looked like just before the accident:



It almost sounds like he'd been drinking. How much time had passed before he made it to the police? Any decent investigator will be able to tell from the damage that he was at fault. Also, you're lucky to have witnesses - use 'em.

Ouch :( I'm lucky that at the point of impact i had enough room to cushion the impact by swerving and not flying off the road.

The police said he seemed sober (roughly one hour afterwords), and I think so too. During the resulting chase, he drove quite fine at about 100MPH on back roads. Not quite good enough to get away from me, though.

Sorry to hear about your car...

I'm in SW OH and would consider selling you my 94 bird. I think it has a few K over 140K. No rust, but could probably use a paintjob, or at least touch up on the one spot it has started to oxidize, and the hood would need repainted. It still looks good when polished up though, I'm just kinda nitpicky. The exterior is tan, as seen in my avatar.
It has a leather interior with some cracks in the driver's seat bottom and one small ( and not very noticeable) hole in the seat back. The rest of the interior is in pretty good shape. It has the ever famous torque convertor shudder, and already has Mercon V, but no j-mod. That's all the bad stuff I can think of.

It already has a full set of the now obsolete Bilstein shocks as well as 89 SC springs which were installed 2 years ago this July. It also has PBR calipers from a 99+ Mustang GT.

It runs great and has been in my family since 59K a few years ago. I really don't want to sell it, but will have to get rid of one of my cars. I would prefer it to go to someone here, as they would probably appreciate it more than someone else might. If you are interested, please either send me a pm or email me at robj8hammer at gmail dot com. I'll try to get it polished up and everything so i can get some good pics soon.

EDIT: forgot to add, clean title, never wrecked. I also have a set of 89 SC seats that need recovered that i would send with it.

Go with his insurance company for now, see what they offer you. If you don't like it, talk to your insurance company and let them do the same process of investigation, looking at the car, etc etc, but they'll be ON your side instead of against you (unlike like the other guy's ins. co.) I'm fairly sure that the hit and run is a felony whether you do anything or not. I might be wrong and you might have to press charges, but you're fully within your rights to press charges, if it is in fact your choice. Don't be in any hurry because the statute of limitations grants you time to get this all settled, because the other guy's insurance will try to usher you through as fast they possibly can.

Talked to the cop today. He said he was at fault and was cited for it. But, so was I, because he said that because I was at a stop sign, i also failed to yeild for a speeding vehicle which i could not have seen. Oh well.

As for the hit and run, no charges filed, so I'll press private criminal charges on him. Grrr.....

Yeah, I'm a little confused now too. It sounds like Vegeta99 came to a road crossing where he had to stop. He did so and when he saw the coast was clear, he made his turn. After making his turn, he looked in the mirror and saw this F-350 coming up fast so he nailed the throttle to get up to speed as quick as possible. But the truck still attempted to pass him in a no passing zone and did not get all the way past Vegeta99 before getting back into the correct lane.

Is this a correct assumption putting 2+2 together?

If it is, and you were fully in the lane when you saw this truck come up behind you, you already stopped and yeilded the right-of-way but at that time, there was nothing to yeild to. It wasn't until you were in the lane that you saw the truck at which time, he should have slowed down due to the "no passing zone".

Yeah, you're correct. It was a T intersection, and you can see far enough up the road to know when it's safe - if people are doing the speed limit. He wasn't. I was going about 45 (ten under) when I saw him in the rear view (I went and played through the accident at the intersection today), and slammed on the gas when I saw him coming up quick. When he made impact, I would have been going roughly 65 (ten over).

He said he attempted to stop at a shooting range up the road. He did not. Even if he did, it's 1.6 miles away. The ensuing chase had me going 90-100 miles an hour, so a little over a minute at those speeds, at "his" speeds (ie, he didn't try to run, so he never went over the limit, according to him), it's almost two. So even if his story was correct, he made NO attempt to stop (there were more than enough driveways) for quite a while. Had my car been disabled, he would have been long gone, but alas, I am 18, and so were all of my witnesses, and he's 57, so therefore, we're making up a story and he is telling the truth.

*sigh* well, maybe i'll get enough out of his insurance company (State Farm :( ) to paint my car... He deserves jailtime.

Has he made any inconsistensies in his story? Any other witnesses? Sorry to hear about all the crap dude, it pretty much goes along with the territory of being involved in a wreck. If I were you I'd just keep at it and keep pushing and pushing until you make some headway. Bug his insurance company or whoever until you make some headway. See if you can overturn your ticket, go on the record, file an accident report, etc. If you really wanna go after him call a few attornies or asks friends if they've dealt with ones they'd recomment, and seek legal council. At the least, a lawyer will give you a little free advice or a going rate.
